27/09/2024 - A 3ª Vara da Fazenda Estadual deferiu pedido de tutela de urgência para a Ação Civil Pública ajuizada pelo Ministério Público de Pernambuco (MPPE) para que o Governo do Estado forneça os óleos Cannabidiol (CBD) 6% e Tetrahidrocanabinol (THC) 6% a uma senhora de 76 anos residente no Recife. A paciente foi diagnosticada com artrose, artrite, demência e problemas renais graves e não possui condições para compra dos medicamentos.
Os óleos, apesar de não serem registrados na Agência Nacional de Vigilância Sanitária (Anvisa), têm importação permitida pela agência. Ambos também não integram as listas de medicamentos dispensados pelo Sistema Único de Saúde (SUS), mais especificamente a Relação Nacional de Medicamentos Essenciais (RENAME).
Assim, segundo defendeu a Promotora de Justiça Luciana Dantas Figueiredo no texto da ação civil, é preciso que o Estado os garanta para a paciente que necessita deles os utilize e reduza dores nas articulações, dispensando a necessidade de analgésicos ou anti-inflamatórios. Com os óleos, também se prevê melhora na capacidade funcional para realizar atividades básicas cotidianas, no humor, sono e perda de peso, trazendo a ela mais qualidade de vida.
